View Full Version : I filed the 130/485 concurrently for my parents

I mailed the 130/485 concurrently for my parents to Arlington Office, VA on 19th of Sept.
My parents are here in USA with B-2 Visa.
Their I-94 will expire on 10-28-03.
I would like to know the next;
1. Do my parents need to extend I-94?
2. In case, if my parents wants to travel to Korea, they need to file only I-131?

I-94 is not extended. Neither do they need to apply for extension of visa or anything. Since I-130/485 has been applied for them, they are currently in "adjustment of Status" period. They can travel outside US using the Advance Parole...

Can you keep me posted on your application? Since I am also living in Arlington, VA and am trying to figure out whether to apply for my mom's green card application in the US or in India. Do you know how long it is taking in Arlington?

Since I posted my issue, I didn't received anything from INS. As I mentioned I mailed on 19th of Sept 2003.
Is this normal?
Anybody knows what the processing time span?

On what basis did you file a I130/I485 concurrently? I thought the visas have to be current in order to do a AOS.

A US Citizen can file for their immediate relatives without any visa limit or being current etc..

My question is if I need to receive any receipt from INS, which shows the file is in processing by now.
Since I mailed the 130/485 concurrently for my parents to Arlington Office, VA on 19th of Sept., I have not heard anything from INS. It has been almost 4 months. I am afraid if this is normal or not.

I think I am going to wait more before I do something since I have read in other thread that Arlington Office doesn't issue a receipt.
Please post any helpful clue or news for me to feel comfortable.
I will post if I have any progress...

If a parent overstays the I-94, and thus is 'out-of-status', how does that affect subsequent I-130/I-485 application? Can anyone care to comment? Thanks.
