hey,
i just went for a stokes on the 3rd of Dec. the interview went well. we were out by about 5-10 mins. just a couple of questions and i also voluntarily gave a few more supoorting docs. he said he was approving but i did not ask him how soon he would approve the same. my Do is Garden City,Ny. any idea how long it will take?

Your stokes interview lasted just 5-10 minutes? You sure this was not your initial AOS interview?

yeah , 'cos i heard stokes takes between 45 to one hour of drewlling stupid questions.

yes because we had all the evidence that they needed and much more and once we gave that he made a copy of the passport and said bye to us. he also said he will approve the case.

When was your first interview? What happened in the first interview to get them to do a stokes?

hey, what exactly was the reason i really dont know. we have a legitimate marriage and a 4 year old son and tons and tons of evidence of living together. what we assume was since i had an already approved employment based I140 approved and decided to adjust my status thru marriage there was some confusion and the IO did not know how to go with it and so she did not give the approval. we finally were able to get and infopass after 6 months and schedule a second interview and thsi time we expalined to the officer why we made this change and he was convinced. he was a nice person too. and knew this was genuine. i was very nervous coz i had heard a lot of not so good things about stokes. but all is not over till you have ur gc in hand so desperately waiting for approval.

It almost sounds like this was just a "2nd Interview" and not really a stokes. Although I have never heard of a 2nd interview like this one. Kinda sounds like they lost the paperwork from the interview and decided to give you a second chance at a "1st" interview.

Very strange.. I'm just glad that he said you were approved. Good luck in getting the GC soon!

My wife filed the I-130 for me, when I was a in removal proceedings, My inerview is schedule for january-08. I t will be the 1st interview for the petition. what kind of interview will be that? it will be a "stokes" interview? or a regualr one? thank you

Well, if you have never had an interview it will probably be a "normal" initial interview.

is there any difference between an inerview for the I-130 itself and an interview where they approve I-485 and I-130 together?

never heard of an I-130 interview... usually they are approved.

That's what it seems in this forum, that everyone file the I-130a nd I-485 together. In my case I was/am not allowed to file I-485 until I close the removal proceeding status. So, the interview I am being scheudle is for the I-130 itself. That;s why I ask. It seems is not common here.

From your timeline, I assume that your wife petitioned for you on Form I-130 while in removal proceedings and you have not filed Form I-485 Application to Adjust Status or Register Permanent Residence.

The interview you have coming up on 1/8/08 is to determine whether the upgraded Form I-130 petition should be approved or denied because it has some bearing on your removal proceedings. The interview for the I-130 is not to determine whether you can adjust status, only a judge can do that for you now.

This is also the reason why your Form I-765 was denied. You were not eligible for this benefit at the time.

I assume you have an Attorney, if so, if your petition (Form I-130) is approved then your Attorney will ask the Judge to grant an AOS application to be presented to the Judge at your next hearing date.

Do you have a date set for your Master hearing?

Thank you for your opinions. Like you said the I-130 approval will not determine the adjusting of status. However, it is a crusial step because the judge will not grant me adjustement of status without having the I-130 approved by the officer. That's why I am trying to find out experiences from people of this forum on the way the handle those interviews.

By the way, I apply to the work permit through the political asylum case. It was not approved becasue the clock stopped before the 150th day. Accordingly to them, they stop the clock as soon as I have a hearing then asking the judge for time, like to find an attorney or to find another way to relief...


My last master hearing was schedule on october, but the attorney filed a case continuation. Then the judge approved that then re-schedule for a hearing in april. Accordingly to the attorney after having the I-130 approved, she can file another continuation for an individual hearing in order to file I-485.

hi davidm992, i have a same problem like u, we went to a stoke interview on 2/12/08, i received a letter after 3 days my I-130 approved but it said they tranfered my case to the court so my hearing date is on 5/16, but last week i received a stokes interview letter again, exectly the first letter i had received before the interview date is on 7/31.
anyone can help??
