View Full Version : URGENT!!! RFE for BC for my mom

Hi All,

I got an RFE from USCIS for I-485 for my mom requesting for BC. I need your advise on this. Here DOB is not registered with local authorities. She is most eldest member in our family and we do not know anybody older than her to give an affidavit.

1. I have obtained a BC from indian consulate. Can I send it.
2. Would it be ok, if I get a BC from the local authority in India now and send it. I read somewhere in this forum that they did not accept the DOB obtained now or something similar a while back???

Also can I send the (1) now and start working on the (2). If I do that what I will be atmost getting from uscis is another RFE correct? Please advise.

Do both #1 and #2.

They will accept a Non availability certificate(recent)

That should suffice since a foreign embassy/consulate respresents the entire country and all its local authorities. The US consulate in Montreal accepted a police clearance certificate issued by the Pakistani consulate in Toronto for my K-1 visa.

Thanks for the replies. Will send bc from consulate and i am working on nabc from local indian authorities.

Birth certificate from consulate is accepted in some cases and sometimes not (I've read of cases where it wasn't accepted). I would suggest send the BC from consulate, but also start working on non-availability of BC and affidavits meanwhile (it might take a while to get those from india). The person giving the affidavit doesn't need to be a family member, it can be anyone older than your mom who can attest that she was born on such and such date/town.
