View Full Version : I-130 question - Wife has previously immigrated

I am filling out an I-130 for my wife who resides in and is a citizen of South Africa. She was born in Rhodesia and immigrated to South Africa in 1979.
Question C16 on the I-130 asks if my relative has ever been under immigration proceedings so obviously I will mark "yes."
Under the section that asks "when" and "where" are four check boxes that read, "Removal" "Exclusion/Deportation" "Rescission" or "Judicial Proceedings"
She legally immigrated when her mother married a South African citizen, and i have a copy of her South African Naturalization papers.
Should I check the box marked "Judicial Proceedings" or should I leave all the boxes blank?

What that question meant is for people who have been under immigration proceedings in the USA such as those who have been to immigration court.
So in your case the answer to the question should be "NO".

you will be interested in the book I have listed as a hyper-link in my signature... it really is worth it... and it's cheap.
It will walk you through step by step, line by line for your situation.... Just pay attention to the *NEW* filing fees as of July 31, 2007 - my copy of the book was published January, 2007 so the fees are incorrect.... just check the USCIS form instructions for the proper filing fees for the AoS
You have been warned more than once already. Stop advertising your book :mad: (for which you get a commission) in every post you make. There is plenty of free resources out there for people, they do not need a book for the process (specially not an out-of-date one). if you wish to recommend it, do so by private messaging.
