Need I-94 to travel with Advanced Parole?

My friend is in pending AOS status (family based sponsored by USC mom)... he currently has two I-94's: one I-94 received when he entered U.S. with F-1, the other one received along with the H-1 approval letter.

He's wondering if his name check is still pending at the interview, would the officer take away his I-94? Would he be able to travel without the I-94, and travel with just the advanced parole?

You have to give up your I-94 when you leave the country. There is no option, everyone has too. Your friend will get a new one when he comes back into the country on his AP it will be stamped as Parole.

I would think your friend will give up the one stamped in his passport and if necessary the one attached to the I-797 for the H1 however the airline will most likely just take the one in the passport.

I don't know if it depends on what country you're from or not, but I have never had to give up my I-94 when traveled between the US and Canada. I've never had to give up or get new I-94's when I've had H1-B and TN I-94's.

Yes, usually IO will take away the I-94 from the passport no matter your case is approved or pending. It really doesn't matter becuase he will get a new I-94 when he re-enter and new I-94 will be stamped as parole. He can travel without I-94 if he brings the AP with him. To be safe, he can also bring other documents with him such as H1b approval letter I-797. In general, AP is good enough. That's my experience.

In this case the OP would only need the AP document and passport to return. And if he/she wants to be re-assured. Bring the I-485 receipt notice.

Turn in both I-94s at the Door before boarding the plane.
