View Full Version : Can GC parents file petition for out-of-status children?

Hi All,

My parents got their GCs last November. I am a GC holder too. My brother and sister have been overstaying in US since 2001.

Question :
1) Can my parents file petition for my out-of-status siblings?
2) Can they adjust their status in US without going back home country as they will be banned from entering US for 10 years once they leave US?

1) Yes.
2) No they cannot.

(1) Yes, provided your or your siblings are not married.
(2) Unless grandfathered by 245(i), no.
