It's all good GotPR. First of all Largolargo congrats. You got what you wanted, so good for you. I am glad things worked out for you. Crossing border like this wasn't really the smartest thing you did, but I am sure since you now have a GC, you can plan your life ahead and lead an honest & happy life. You can put your past behind and start a new future with your family.

Now, as far as starting this new thread, I don't see any issue with that. It's Largolargo's big day so let her enjoy. I have seen ppl here who would start a new thread with some basic/useless questions which has been asked by millions of users before. Nobody stops them so why her. She didn't take too much traffic, I am pretty sure :)

I'm not against someone starting the new thread for good reason, however, OP clearly has some personal agenda whhich is the primary reason of this thread and s/he even kept evading giving the details when people asked detailed in the previous thread. I'm pretty sure s/he won't answer the Q that RC asked. I don't know how this thread could be helpful and useful.

js360 I understand your feelings towards PraetorianXI. He seems to have contributed a lot to this forum that's what I have heard. Let's give him atleast that credit for replying promptly. If you think about it, what is he getting in return.....nothing. Now as far as being blunt and rude, that's ofcourse nobody would like it.

In short it will be nice if we all could work together as a team and not hurt each others feelings.

No tricks here as you see, my case was done legally with the help of a lawyer who knows Immigration law contrary to you who pretend to know it all. One thing I know for sure I'll never take any advise from you.

I paid a fine of $1000 dollars for entering illegally, plus I had file a case under 245-I

We all are happy, so why the need of like "hahahahah I was right", no you weren't, because you where the one who was asking for opinions, nobody else knock to your door asking you things to you and you even did not gave enough facts about your case to even been able to help you...and I know how many post we received back in 2005-2006 many post looked "weird", that is a fact. If you had already your mind set so why then post to ask for advices, you already had a lawyer.

When people post here will get all kind of answers...is in you, again as my previous posts, is YOUR choice to follow or not. I would like to know if you were denied you would post saying that most of the "negative posts" were "right", so far nobody answer here saying "I am telling you this because I am right". Nobody here is a professional on immigration laws and mostly people post, including myself, about what was heard, what happened from other people in the same situation, what you read and your own experience. Now, if the person returned without a problem, hey I am more than happy that she was able to do it, this is not about “heheh I was right, I am so good”, that is not true. I really wished she was able to get back. Probably they did not count correctly the dates that she overstayed OR they got lucky. Whatever is, good for them. Does my opinion will change after that? No, my opinion remains the same if somebody asks me again the same question under the same circumstances. Is not negative, is my opinion and I don't consider myself a negative person I am pretty down to earth. Back to this post if you read his/her signature states 245i, please read further about it...if that the case then is a totally different case and do not apply for other situations were people was not inspected before, still the law is pretty clear and states (current law) that a person who entered without inspection can't adjust status even is marry to a US citizen and nobody is inventing the tire with it! Of course there are exceptions (we don’t recall or remember ALL of them, which are why you should go to a lawyer!) but is in you to look on this and people can give you more details or advice only and only if the original poster gave enough facts. His case is back to 2000, which most of the people who post here nowadays do not apply or just as easy do not give ALL the facts and pretend that people keep asking over and over for more information like we will know about other's life like a magician.

Again, why don't get proactive and so much of a good case and explain ALL your case? When you marry? Did you divorce? How many times you get in and out of the US? Which dates you gave to the IO? Which information and evidence (RealCanadian asked the same) you gave to USCIS? Was a petition filed before 2001? Did you use the 245i? There is a lot on this case that is missing to be able to help others. I am looking for that, if we know more information about this, would be a great help not only for us in the case that other person post but others who could be in your same situation and has no idea what to do.

People, remember many things can be said, but there are A LOT of cases were the OP never gave enough facts and information and even on those “negative posts” many of them states that many things don’t match, why? Because people don’t give all those tiny details that can make a difference and then you pretend that people give you “yes, you can do it” but then you forgot to say that they catch you with 100 kilos of marihuana 2 years ago…hello?

Same as the other post to take kids or not to the interview...is your choice ATL Brother, but if you go to the Peachtree Dunwoody office, is a very small area, is a room, that was MY experience in 2005, probably it changed now, I don't know, I just can tell you my personal experience...I know what happened there, that was my own experience, take it or leave it, has nothing to do if I understand or not about kids, I have taken care of kids and I know about kids, there is not special formula on it and each kid is different. Is very sad that apparently here just few decide that others just gave negative opinions just because they do not agree with one of you, then is wrong or right or you are a negative person? jeezz, how you work with others?...I am not defending anybody just a new wave that I keep watching over here, because you have kids and can't find a babysitter is not USCIS and nobody else problem, btw it was your choice to have children, that's a fact of life. It's an opinion, I guess people skip dictionaries at this stage of life and don't get the meanings of words correctly.

As Austriacus put it very well the other day, is good to have ALL kind of opinions, do you agree all the time with your spouse? Do you have friends that always tell you that that ugly pink with blue dots tie looks good on you? I don’t think so, and you always get mad at them because they tell you a truthful answer even if you don’t like it? Is in you to use the tie or not, at the end you are the one who is going to wear it. You will find people that will tell you “yes you can do it” and other that will tell you, “I don’t think so” others will tell you that “you should go back to your country”. All of those have the right to post here…that’s the difference. Is not so much of the land of free speech that you want to be, so then that “free” came with a lot of others things…meaning you will get things that you don’t agree with but you can’t kill or start getting mad every time you get an answer that does not fit your needs or your wishes.

Again is so much of a helping post, why you don't be so kind to post ALL the FACTS of your case, because so far I am still convince that your case is different and still if you read the current law, people can't adjust status in the US if they cross the border, if that so, won't be so many people screaming for amnesty. And that’s not a negative fact is a real true fact if you read the law. Yes, there are exception but you must read about it as well.

245i beneficiaries DO NOT have to submit evidence of being inspected. However, they have to prove they were present in the USA on December 20, 2000.

there is no life or death situation with me, I been here in the US for 18 years with no problems, good job, traveling all over the states and even to foreign countries , I am thankful my situation is finally legal here and I hope everybody who deserves to be here would get theirs soon

Seems most people here have rather comfy immigration, going from a good life in another country into a great life in USA. Not many people here, thank God, Know the desperation that can make a person walk accross a desert and sneak accross a border. which I realize isn't exactly your case, but it is for many people out there.

I admire that you had the strength in your soul to keep believing that one day you will be free and legal :)
You deserve your freedom, and you deserve your passport in the end. I hope you get it in the smoothest smooth application process, and may God richly bless your life here so that you may help whoever had to stay behind until they too can come to freedom.

Grats Largo! This is why you should hire an attorney if you're in a unique situation, you cannot just trust anyone's advice, especially on an internet forum.

Check this out. I bet you will enjoy this. Lot of times even good attorneys will try to trap you and do whatever it takes to get your business. You remember that Sharina & myself got cancellation notices for our upcoming interviews in May. They were cancelled for God knows what reasons but this attorney told me that she has never heard of interviews being cancelled. There is definitely wrong with our file/case and FBI will be coming to arrest us anytime so her advice was I better hire an attorney right away. She will get started on my case if I charge $1000 bucks on my credit card. Wassup with that ?:rolleyes:

Oh yeah. My previous attorney told me that I would be arrested at my Green Card interview because of my two year old marijuana misdemeanor and that I would be deported that day. He told me it would be difficult... but if I gave him a $1000, he would go there prior to the interview and "sort things out for him".

I didn't know whether to be apalled that he thought that I was that stupid or that he only asked for a grand.

It also made me think, if immigration attorneys try this with reasonably literate people who know how to type in http://www.google.com and do some research, what must they do to people who are really clueless about the whole process?

Yeah . like your GC is not your life and death , hope it slips away from you , then u will know what life and death is , Largo was worried because he has a family and no one wants to lose his or her family, may be u dont care losing ur family , because then u will go to some other country and start a new family isnt it Southner :D , and again no one cares for your interpretation of immigration laws :-) , if you were capable enough u wud have made a pretty good living out of it rather than coming here and wasting ur time ...

Well, actually praet posts good advice. Largo's case was very unusual though, not only because the obscure 245(i) section applied in this case, but also because, and I don't know if they are aware of this, the previous I-130 petition filed before 4/30/2001 and the physical presence on December 21, 2000 made the illegal entry into the country irrelevant. Were not for that, AOS would have been an impossibility.

Well Praetorian not to bring up old stuff but my friend's wife is from Mexico. She walked across the border in California at age 14 undocumented with parents, no inspection.

She then got married to her husband(US Citizen) my friend, adjusted to LPR.
During her illegal status time she used fake SS#, fake green cards, and many times claimed US Citizenship on I-9's. She even got cought at the US/Mexican border trying to reenter the US illegally.

She was in Mexico visiting her mother still undocumented, came to
the US border to try to reenter and told the agent that she was a US
Citizen. They didn't believe her, so they took her to a room and
interviewed her. They also finger printed and photographed her. They found out the truth then send her back to Mexico. This was in the year 2000. At i-400 interview none of this was ever discovered by USCIS

After all that she adjusted her status to LPR, and now she will be
a US Citizen on June 13 after taking oath in Tampa Florida.......

So when you say good luck at I-751, and I-400 I don't think the op will need much. As my lawyer has said, USCIS is SOOOOOO backloged they just don't have the reasources!

well, the USCIS did find that Phillipino couple that got married and still lied on their applications and got their visas as unmarried children of LPRs. Guess what? they are getting deported now, after applying for citizenship, 20+ years after getting a GC.

1 difference Lucy, my friends wife already has been approved for citizenship.....she's past the interview.

I dought that will happen. If they havent already found out It won't happen espically with over 2 million cases backloged from 2007. Look above the law, They don't have the resources.
