Hello All,

Not sure if this is the right place to post but here goes. I am a GC holder, who will be marrying an H1B holder soon. Her company is not applying for her GC, so does it mean she will have to go back as soon as we get married and I apply for a change in her status.

Any help would be appreciated.

hi,

If her company does not process her GC, you would have to sponser her GC in family category. That means it will take 5 to 6 years for her to get her GC in family category. Untill then she will have to maintain her H1 status or her F1 status. The fastest approach would be is to find a company that will sponser her GC in empoyement category.

once you become a citizen, you will not have to wait for visa number become current for her green card. Make sure she maintains her legal status by herself until you become a citizen.

Thank you all for your advise. I will be meeting my lawyer monday to clear any other confusion.
